Page 2 of the UC form looks pretty easy to complete.  SDUSD Stakeholders have 22 check boxes to choose from with associated CDE Education code listed beside each option.

DD Tip

Easy, right?  It can be but…

If you DON’T follow a specific Statute of Limitations criteria, grade verification, law qualification and evidence documentation gathering process, nothing could be further from the truth. 

But don’t let that discourage you.

UC filing success is possible IF you follow the FULL process.

Just like we mentioned in Chapter 3, MORE is better when it comes to filing UC’s.

Having MORE SDUSD Stakeholders joining into the filing of the SAME UC adds to the pool of evidence and to the credibility of the UC.

Having MORE UC BOXES CHECKED on the UC Form, backed up with DOCUMENTATION evidence for each, adds to the scope and scale of the detailed SDUSD violations against multiple Students and other Stakeholder groups.  As long as you have corroborating evidence for additional violations for the same incident, be sure to check those additional boxes.


But BEFORE you can check any of the boxes you must clearly and directly correlate your specific Uniform Complaint incidents to the specific California Education Code “federal or state law or regulation” violations.

This chapter we have added 2 additional “official” sources for this information:

  2. CASETEXT Legal Research Website for a reader friendly version of the same actual California laws.

  4. GovInfo for details regarding Federal Education Law

We have provided a variety of  “Violation” links to all of these sources in this chapter for our readers to gain a good understanding of these laws.

But the first criteria to determine is “GRADE LEVEL”.  All of the Violations listed have a “Grade Level” implication.  Some Violations can impact ALL grade levels  Other violations may only impact some grade levels or all but 1 grade level.

For instance, the first checkbox labled “Adult Education” would only apply to “High School” or “Post” and NOT apply to “Pre-K” or other grade levels.

In order to assist you in accurately identifying the boxes to check on the UC, we have used both sources to create the following SDUSD Violation Grid (SVG) that will assist you in identifying the grade level for your UC violations:

Once you have verified that the violation is relevant to the grade of the children impacted, the next step is to look at the actual law that has been violated.

To assist you in that task in Chapter 4(b), listed below are a variety of California Education Code “federal or state law or regulation” violation links for boxes 8-14 on the form.  Last week we featured boxes 1-7 from the form and next week we will feature Chapter 4(c) with boxes 15 – 22.


DD Hint:

Although it may seem laborious to read through all of these UCP Codes and Laws, we STRONGLY advise that you do so.  Through years of working with families and individuals wanting to file UC’s against the SDUSD, we  have universally found ADDITIONAL violations against the SDUSD tied to multiple UCP checkboxes.  Being well informed and thorough is extremely important so that you hold the SDUSD to FULL Honesty, Accountablikity and Transparency so you know ALL the boxes to check while your family is being victimized.
