With the beginning of the 2023 New Year we are filled with renewed resolve to hold the San Diego Unified School District (SDUSD) to the Educational “HAT Trick” of FULL Honesty, Accountability and Transparency.

Last week we also defined what the first step would be:
THAT is why, beginning next Sunday, January 15, 2023, we will begin this year long quest for the SDUSD HAT Trick by analyzing the “H” out of SDUSD Honesty. We will provide our readers the tools and insights needed to find, fight for, demand and expose honesty and the truth from every level of the SDUSD…from Pre-k to 12, from hourly to certificated to appointed and elected personnel, from the SDUSD to the San Diego County Office of Education (SDCOE) to the California Department of Education (CDE), the United States Department of Education (USDOE) and the United States Office of the Inspector General (USOIG).
We committed to “provide our readers the tools and insights needed to find, fight for, demand and expose honesty and the truth from every level of the SDUSD“.
For that edict, today we are presenting the first handbook in the District Deeds HAT TRICK Series titled “Tips for Stakeholders Filing a State of California LEA Uniform Complaint – San Diego Unified School District Version”

PREFACE
First, please read our District Deeds Disclaimer HERE.
There are other types of CDE Uniform Complaints you can file (“Williams” and “State Pre-School) , but we start our quest for the SDUSD HAT Trick with a guide for filing a successful (as possible) “educational programs and services” Uniform Complaint (UC) against the SDUSD.
Along the way we will be providing “DD HINT“‘s and “DD Tip“‘s to highlight key information that Stakeholders should know when filing UC’s.
Last Sunday we provided our readers with “the most recent Uniform Complaint Procedure Handbook dated December 2, 2022 by the California Department of Education (CDE)” as a prep for the recommendations we will be making to help each and every one of you to “fight” for the educational rights of your Students. If you have not yet read through that document, please click on the link in red above and do so now before proceeding.
Introduction
What you read from the CDE in the Preface are the official instructions for filing a LEA (Local Education Agency – the School District) UC, one of the the primary methods of holding a LEA to Honesty, Accountability and Transparency for its misdeeds in the following areas:
You may have also noticed that the SDUSD document from the district website mentions “evidence” 11 times. However the SDUSD document neglects to give the SDUSD family/reader/complaintant any definition or example of what represents compelling evidence of wrongdoing in a California school district, let alone a HUGE school district, like the SDUSD. The same SDUSD that has invested millions of dollars into departments (Legal/Quality Assurance) to cover up violations and prevent any and all complaints to be HONESTLY rectified. As a cornerstone of out HAT TRICK effort, without Honesty there can be no Accountability or REAL Transparency.
A great example of this dishonest SDUSD scam to prevent complaints from being addressed is the ridiculous “Quality Assurance Department” (QAO) flow chart that is prefaced by trying to diverting MAJOR SDUSD violations to a downgraded local school site “question/inquiry” or undefined “concern” category underlined in red below:
This tactic relies on the school site Principal, Counselor or Teacher to defuse a horrific violation without a Uniform Complaint…and then forcing the Stakeholder to jump through 10 hoops before even getting to file a Uniform Complaint against the SDUSD:
DD TIP: The SDUSD QAO reports DIRECTLY to the SDUSD Legal Department!
During ALL these sidetracks, 3 events occur:
- The corrupt Quality Assurance Office feeds all of your confidential complaint evidence and infomation to the Legal Department.
- The Legal Department has time to review your evidence, perform a lawsuit risk assessment and prepare a legal defense against your evidence and valid complaint to avoid prosecution.
- The delay allows the SDUSD to minimize, compromise, adjust and erase (when possible) the incriminating evidence Stakeholders have missed or not submitted.
And then there is a 4th impending event created through the “Question/Inquiry/Concern” delay and the 10 step QA Flow Chart scam:
4. During all this evasion and subterfuge, the short 6 month Statute oif Limitations clock is ticking for the most serious offenses against the SDUSD. Here is the wording directly from the SDUSD Website:
Statute of Limitations
Complaints alleging discrimination, harassment, intimidation or bullying must be filed within six months from the date the alleged discrimination, harassment, intimidation or bullying occurred or the date the complainant first obtained knowledge of the facts of the alleged discrimination, harassment, intimidation or bullying, unless the time for filing is extended by the Superintendent or his or her designee.
SIX MONTHS!
It is very clear why the SDUSD QAO and Legal Department would LOVE to delay a Stakeholder complaint through extended “Questions/Inquiries” and “Concerns” at the school site level with Teachers, Counselors and Principals before even getting to the lengthy 10 step QA Flow Chart scam.
And this is not even accounting for the intimidation effect time delay against families of low education/low income/language barriers or combinations of all three.
Under those conditions, 6 months flies by fast!
In the coming chapters we will define the best possible way to eliminate the Legal Department delay time, gather the BEST type and quantity of evidence, the optimal method and timing in submitting complaints, and best strategies to drag the corrupt SDUSD, kicking and screaming, to a minimal semblance of Honesty, Accountability and Transparency…
