According to SDUSD Superintendent Cindy Marten, apparently NOT!
In an article published today on inewsource.org by Mr. Chris Young titled “Should San Diego, Carlsbad Schools Have Told Parents About Sex-Assault Investigations”, evidence uncovered through a Freedom of Information Act Request (FOIA) proves that Superintendent Cindy Marten covered up the SIXTEEN MONTH SEX ASSAULT INVESTIGATION by the Federal Department of Education Office of Civil Rights!
The District Deeds answer to the question “Should the San Diego Unified School District have told Parents (and ALL SDUSD Stakeholders) about Federal Sex-Assault Investigations?:
ABSOLUTELY YES!!!
Student Safety IS THE PRIMARY AND ABSOLUTE RESPONSIBILITY of the Superintendent…and SDUSD Superintendent Cindy Marten has failed miserably…and then lied and covered up the guilt of the SDUSD.
According to the article, San Diego Unified School District was ONE OF ONLY SEVENTY FIVE school districts being investigated by the Department of Education Office of Civil Rights.
That means that those seventy five districts were “chosen” out of 13,515 School Districts in the United States for a Federal Investigation. In other words, San Diego Unified is in the horrible .6%..six TENTHS of a percent of ALL Public School Districts in the United States when it comes to Sexual Assault Investigations.
The case being investigated occurred at Green Elementary and has been exposed in depth in the District Deeds articles by Guest Writer Judy Neufeld Fernandez. Multiple sex assault incidents occurred at Green Elementary beginning in May, 2013.
As a reminder, on March 10, 2014:
There are “extensive measures in place to protect students whether in an emergency, a bullying situation or suspected child abuse.”

In May, 2014, the parent of the sexually abused student, after being blocked at every turn by Superintendent Marten and the SDUSD, filed a formal complaint…only 2 months after the Cindy Marten “Protect Students” lie.
In September, 2014 Superintendent Marten REJECTED the complaint with the following “logic”
“The District concluded that the principal was correct in not applying its ‘zero tolerance policy,’” which covers incidents including sexual assault and harassment. The district claimed that it did not apply to elementary schools “because elementary students do not have the relevant mental state for engaging in sexually harassing behavior.” – inewsource
Let’s repeat that logic again…

THIS is the Supt. Cindy Marten version of “extensive measures to protect students for suspected child abuse?!?
All it did was ADD INSULT to the Sexual Abuse injury and pain of the family…and dooming the rest of the SDUSD to the SAME FATE!
Ultimately it is just another LIE from habitual LIAR and Incompetent Supt. Cindy Marten.

The worst part?
Superintendent Cindy Marten and the SDUSD kept STUDENTS AT RISK AND PARENTS IN THE DARK FOR 16 MONTHS!!!
IF Superintendent Cindy Marten and the SDUSD had been HONEST…
- How many Parents could have had discussions with their kids to warn them?
- How many PRINCIPALS AND TEACHERS could have been alerted to Student Sexual Assault risks in classrooms and bathrooms?
- How many 5 year old, 6 year old, 7 year old and older STUDENT Sexual Assaults could have been prevented?
We will never know…but we DO know a few things…
By putting SDUSD Students at RISK OF SEXUAL ASSAULT, Superintendent Cindy Marten has proven herself TOTALLY UNQUALIFIED to be SDUSD Superintendent.
Superintendent Cindy Marten MUST IMMEDIATELY RESIGN…or be FIRED for the protection of our children.
Until one or all of San Diego Unified Trustees Richard Barrera, Kevin Beiser, John Evans, Mike McQuary or Sharon Payne call for Martens’ resignation or firing, they are RESPONSIBLE for ALL SEXUAL ABUSE of Students in the SDUSD….and NONE of them deserve to be re-elected!

Hello Frank and thank you for all your hard work keeping the SDUSD community well informed!
I have been with this district since 1986, first as a student, then as a community member now as the mother of four, including a four year old with special needs.
Things have actually worsened for the most vulnerable students in these thirty years and no matter who the superintendent is, the injustice and mismanagement will continue unabated until the State and Federal governments demand compliance.
It is the teachers union that currently reigns; this district now solely exists to finance the careers and retirement of its employees. Our sons and daughters are just afterthoughts. This affects every family in the district, but it disproportionally harms disadvantaged students whose parents are not able to advocate on their behalf due to language, employment, or cultural barriers.
I continue to bring attention to the discriminatory practices committed by this district against parents of students with special needs, English learners, low income, and minority students.
As parents, there is something we can learn from the teachers union: to stand united and never give up. Unlike the union, we fight for the present and future of our children, not for a paycheck.

Fancisca, how do you protect yourself from the district going after your job? They most likely view u as a threat and we know what that means..employees such as yourself eventually being bullied and harassed for informing parents of the harms their kids are exposed to. I dont know how any can sleep at night if they have been silent. There are few of us out their and soon maybe one less if the district gets their way..take care..and do share if u have been successful in thwarting their attacks on u resolve to be the educator that parents hope and wish they have for their childten in school.

As a teacher, who has worked for the district for over 20 years, I disagree with Francesca’s assessment of the teachers and the union. Without respected and well compensated teachers, the education of our children will lag, as it currently does. During the recession, teachers voted to take a pay reduction in order to retain teachers and keep class size down. The issue with the district, is not that it is run by the union, but rather by an oligarchy of former “Bersinites” who are making the same mistakes that were made under his regime. Half-assed implementation of imported programs and approaches that are rolled out to the staff in a hurry, without the time nor funds to support them. As in many large bureaucracies, more money comes to the district and more administrative positions are created to oversee the teacher worker bees who are now expected to “equitably” educate GATE students, average students, special needs students, EL students, low income students, etc. with expertise in one classroom at maximum capacity. Heaven forbid, students be pulled onto smaller groups where they can work closely with a specialist to accelerate their skills. Dismantling the NAC is the latest casualty of the quest for “equitable” education. I think the district leadership may need to review the meaning of equitable.
Not too worry, as the district leans more heavily on technology, there will be fewer teachers to pay, and more machines and software to maintain.
