Multiple news reports from San Diego based media sources have confirmed that the San Diego Unified School District and Trustee Marne Foster have been sued by SCPA Counselor Kim Abagat.

According to an article by Ken Stone in the Times of San Diego:
“Although Ms. Abagat has been a hero to many students in need, here she’s the victim of a power play by a corrupt, vengeful trustee and a submissive but complicit school administration,” said Daniel Gilleon, one of her lawyers.
“The wagons at SDUSD have been circling for many months,” he said in a statement Thursday. “I wonder when Superintendent [Cindy] Marten will start telling the whole truth about Ms. Foster’s incessant meddling in employees’ careers for her own personal gain.”
Union Tribune reporter Maureen Magee wrote an article titled “SCPA Counselor Sues SDUSD, Foster” describes the “sham” by Marten and the lawsuit:
The lawsuit accuses Superintendent Cindy Marten of ordering a “sham” investigation to find out what happened with the college application. Abagat was suspended without pay for nine days, and Principal Mitzi Lizarraga was eventually reassigned. Marten has said the popular magnet school suffered from management troubles before Foster was elected, but that the personnel changes were made, in part, because of Foster’s complaints.
Marten HAS been lying to the SDUSD Stakeholders since she was improperly appointed Superintendent…and now she is being consistently EXPOSED for being a liar!
Mario Koran also posted an article titled Lawsuit Claims Retaliation by Schools Trustee Marne Foster. Mr. Koran mentions the scope of the lawsuit and also quotes Attorney Gilleon:
Because “Foster acted with malice, fraud and oppression, in conscious regard of Abagat’s rights,” according to the suit, Abagat is seeking punitive damages, including attorney fees and pay she missed for her suspension.
“This is what happens when we have elected officials coming into schools and meddling in affairs that are supposed to run by professionals,” said Dan Gilleon, Abagat’s attorney. “Foster clearly was not acting on behalf of the school district. She was acting on behalf of herself and her kids.”
Everything that these San Diego writers have written is true.
But District Deeds has a question:
When will Superintendent Cindy Marten be held accountable for her improper support of Foster and for the many, many lies she has told ALL the SDUSD Stakeholders?

RESTORE THE FAITH IN SDUSD LEADERSHIP NOW!

Good Lord !!!! The School Board members need to act ASAP !!! Suspend Cindy Marten pending the outcome of this investigation !!! Teachers, Parents, Community wake up to what is going on !!!! Laws have been broken, incompetent Administrators are being put into positions they are not qualified for. Marten continues to spread her fools around the district !!!! How many law suits does it take against this Administration before they are gone ? Board Members do your JOB !!!!

Exactly right, Allannah. A responsible school board, who puts the education of children first, would have removed Superintendent Marten by now.
But this board made a stupid mistake and picked someone who had no experience qualifying her for the job. But she did have some friends on the board. Not what she knew but who she knew..as the saying goes.
For the school board to remove her, Barrera, Evans, Foster and Beiser would have to admit they did something wrong..unethical even…They won’t.
