In a twelve page letter sent to the San Diego Unified School District (SDUSD) that details 4 distinct ways that the 2018/19 LCAP/LCFF is not compliant with Education Laws, the San Diego ACLU (SD ACLU) has exposed incompetent Superintendent  Cindy Marten and her crony Board of Education Trustee Richard “Tricky Dick” Barrera, Kevin “Dismissal with Prejudice” Beiser, John “You Can’t Handle the Truth” Evans, Michael “Foggy Bottom” McQuary and Sharon “Flying By The Seat of Our Pants” Payne as the flimflam con artists they are.  Here is the definition from Vocabulary.com:

The first item mentioned by the San Diego ACLU addresses how the SDUSD FAILS at tracking how LCAP funds were carried over. reallocated or tracked when moved between budgeted and actual expenditure destinations.

When we were a member of the Title 1 Tiger Team in 2011, we recognized this tracking problem and made a recommendation to solve this issue using the “Trailing 4 Digits” in the numerical budget string to accurately track and report Title 1 expenditures.  Here is our recommendation from 11/8/11: Trailing Four Digit Implementation Recommendation Plan 11-8-11 

Implementing our “Trailing Four Digit” plan would have easily avoided this obvious transparency violation.

The second item exposed by the ACLU is very familiar to all SDUSD Stakeholders.  Marten and her Trustee cronies using LCFF funds for district wide initiatives when they should be used for specific groups of students is just another, underhanded way of supplanting targeted LCFF funds for the neediest students through district wide initiatives serving ALL students  Supplanting is outlawed by the U.S Department of Edcucation…here is a document titled “Supplement-not-Supplant under Title I of the Every Student Succeeds Act” that further provides proof of the SDUSD LCFF violations

Item 3 from the ACLU is directly related to the total lack of transparency and accountability by the Marten regime supported by the SDUSD Board of Ed.  We posted an article in the March 11, 2018 edition of “District Deeds Sunday Reads”

In the post regarding an article titled  HOW STAKEHOLDER ENGAGEMENT FUELS IMPROVEMENT EFFORTS IN THREE CALIFORNIA SCHOOL DISTRICTS  we said:

In Palmdale: “Officials have increased transparency around school and district activities, even going so far as to train school and district leaders on how to share positive and negative data, and to publicly acknowledge when they have no answers or have made mistakes.”
“Increased transparency” and “Superintendent Cindy Marten” are mutually exclusive terms in the SDUSD.
“publicly acknowledge when they have no answers or have made mistakes.”?!?
WOW…it is virtually impossible to find during the Marten regime when the SDUSD has volunteered to “publicly acknowledge” they have “no answers or have made mistakes”.
All we really get from SDUSD leadership is LOTS of propaganda with no admission of her numerous blunders, lies or guilt despite proof of their misdeeds including Grand Jury rulings. a Trustee collaborator conviction/resignation and a $124 million budget mismanagement disaster as evidence.
The SDUSD is in a constant condition where her incompetent actions SCREAM louder than her propaganda words.

Item 4 is related to total lack of Stakeholder engagement.  The ACLU claim is COMPLETELY true…the Marten regime does their best to avoid REAL “Stakeholder Engagement Requirements” and replaces it with fake PR events.

In Anaheim Union:  “district officials have sought to build parents’ understanding of the standards and related instructional shifts in their home languages with the help of family and community engagement specialists and support from California State University, Fullerton. According to the report, hundreds of parents now show up to LCAP planning meetings with an ability to understand the data and meaningfully partner with each other and with district leaders and school personnel to set district priorities.”
This year San Diego Unified did away with LCAP planning meetings and decided to provide 1 poorly attended LCAP “workshop in June, 2017 and a web based survey for a one week period in only a fraction of the languages spoken by families in the SDUSD, the majority of which may not have computer/internet access or skills.
Classic SDUSD/Marten/Trustee avoidance of “Stakeholder Engagement”.

District Deeds wants to publicly THANK the San Diego ACLU for stepping up and holding accountable SDUSD Superintendent Cindy Marten the Board of Education Trustees Richard “Tricky Dick” Barrera, Kevin “Dismissal with Prejudice” Beiser, John “You Can’t Handle the Truth” Evans, Michael “Foggy Bottom” McQuary and Sharon “Flying By The Seat of Our Pants” Payne on behalf of ALL SDUSD Stakeholders..especially the neediest students in the neediest schools.

We only have ONE request of the SD ACLU…

Please DON”T let the SDUSD off the hook with their typical flimflam excuses when they reply on August 15th…do your best to MAKE them comply to Education laws!
