The REAL Supt. Cindy Marten “Season’s Greeting” courtesy District Deeds!

The recent San Diego Unified “special light inside every child!” Season’s Greetings on the District website could have been called the SDUSD “special fright inside every child” given their Corporal Punishment treatment and disrespect of 9 and 10-year-old Horton Elementary Students and their Families!

Complaints by Horton Elementary Parents and the ACLU against San Diego Unified have claimed that 9 and 10-year-old students at Horton Elementary were physically abused through “planking”, a form of Corporal Punishment, by the Horton Principal, a Supt. Cindy Marten crony she had appointed in 2015 with no previous Principal or Vice-Principal experience according to her LinkedIn profile:

Here is the complaint letter from the ACLU: ACLU-Horton Letter 11-28-16

Typical of the authoritarian and dictatorial Supt Cindy Marten regime,  when the parents complained about the Student injuries and the treatment of their Families, they were BANNED for 2 WEEKS from the Horton Elementary campus by the Principal,  the SDUSD Police and Supt. Cindy Marten!!! – District Deeds

Multiple news outlets have published reports on the incident and subsequent complaints since the 3 days of pain occurred on October 14, 17 and 18 during the lunch period.

UT@Board

The San Diego Union Tribune Editorial Board posted an editorial that slammed the SDUSD for allowing the Corporal Punishment to occur titled “Memo to Horton Elementary: Corporal Punishment was Banned 30 Years Ago“.

KGTV 10

San Diego Channel 10 provided pictures of the Student injuries.

But like we told you in our “$14 MILLION Legal Cost” post,

Past and present senior members of the SDUSD executive team have mentioned many times that the SDUSD is NOT run by the Board of Education or by the Superintendent.

They say it is run by the Legal Department.

To Marten, the safety of students is simply a Legal matter…not an Ethical one.

  • No matter the testimony by the 9 and 10-year-old students and their parents.
  • No matter the injury reports and details provided by those parents in their complaints and the complaint of the ACLU.
  • No matter the pictures from Channel 10 and the rebukes by the San Diego Union Tribune.
  • No matter the QUOTES of the Marten appointed Principal that acknowledged it occurred and that it was a “consequence”.
  • No matter that it is unethical for students to be injured by lack of effective operational oversight and proper Principal appointments by Supt. Marten.

San Diego Unified DENIED all complaints and even DENIED it was student abuse by corporal punishment.

Is there any doubt why Legal Expenses have BALLOONED since the unethical and incompetent Superintendent Marten was appointed?

Is there any doubt that it is standard operating procedure for Supt. Marten to allow student abuse cases to occur and be covered up by the Legal Dept….similar to the coverup and lawsuits at Green Elementary and other examples?

Our conclusion regarding that the SDUSD “is run by the Legal Dept.” was eerily reminiscent in the San Diego Union Tribune Editorial today, December 29, 2016 titled “Horton Response: An Awful Look for San Diego Unified“:

Everyone who has a stake in a well-run, humane San Diego Unified School District should hope the district’s formal rejection of allegations that students were mistreated this fall at Horton Elementary School — and its refusal to apologize for Principal Staci Dent’s bullying some of the students’ parents after they complained — was dictated by district lawyers wary of a lawsuit over illegal corporal punishment. If this is not a legal strategy, it is awful. San Diego Union Tribune Editorial Board, 12-29-16

Using historical perspective of the inept Marten governance the past 3 years and evidenced through this callous and harmful rejection by Marten and the SDUSD to the honest complaint of student injuries by the families at Horton Elementary, District Deeds believes there is only one answer to the “hope” premise in the UT editorial:

If Marten ALLOWED this as a “legal strategy” or even if it is just another one of her countless management blunders, as long as the incompetent and unethical Marten is SDUSD Superintendent there is no hope of a “well run and humane San Diego Unified School District”.

Ask Sally Smith…who helped the parents file the complaints

Ask Judy Neufeld-Fernandez…who is dedicated to helping families of abused students

Ask all the families from our San Diego Unified Student Abuse Report.

They will all tell you, as long as Cindy Marten is SDUSD Superintendent, there is no Transparency or Justice for students who are abused.

And since, As long as Marten is Superintendent, there will be…

NO JUSTICE!

District Deeds believes there should be

NO PEACE!

I’m very glad that Sally Smith helped the families file complaints; not surprised that the district denied them.

As a Latina mother of four, including a four year old who has a disability and a long-time resident of Logan Heights, I felt I should’ve been happy that the district held a “Celebration of Light.” But given the way that parents are treated, I found it very self-serving and hypocritical. There is ling-standing and continuing mistreatment of parents, especially those who are minority, limited English-proficient, poor, and or who have children with special needs.

I have filed numerous dicrmination and non-compliance complaints with the district and each one of them has also been denied. Due to limited time and financial resources, I had been unable to file timely appeals, however when the district again targeted the most vulnerable students (the abrupt closure of the Logan Elementary Child Dev. Ctr.) and families for budget cuts in a clearly discriminatory manner, I said enough and filed an appeal and the State is investigating. I hope the families affected by the district’s abusive practices receive legal help to pursue further legal action so no other children are harmed.

Thank you District Deeds for all your hard work and Happy New Year!

  2. One more report on this child abuse at Horton was written by Maureen Magee and appeared in the Union Tribune on Dec. 27.

Worth reading and can be found by searching “SD Unified dismisses complaint over student planking punishment”.

    • We had read that article…we post very little by Magee since she is the positive media crony for Marten and Sharp…only positive spin posted by Magee so they will never threaten her like they do VOSD reporters.

      • I agree about Magee’s reporting.

This article seemed a little different, because Maureen quoted the Uniform Complaint Officer Lynn A. Ryan, who gave the district side but also included the ACLU reps comments.

Sharp seems to be delegated to a backroom job, as Shari Winet, who is also quoted in this, is the new communications director, I believe.

You’re right about past bias in the UT reporting and how SDUSD punishes those who don’t write what they tell the reporter to, as in the VOSD case with Sharp…but this gave a lot of info that I doubt Marten and the board would like to have published.

Thanks for all the good reporting you do, Frank.
